Terms and Conditions – Wedding Photography
(Company profile)
Ocean Studio Fiji Limited is Fiji’s leading photography company with Quality and Trust. Yoshi Kawai as Principal photographer and Managing director is well respected with professional works and reasonable business practice. We have lots of clients and we deal with many resorts in Fiji. With our customer focus mind we always do the best for every single customer, and we have made more than 3000 wedding couples happy in the past 20 years experience in Fiji. Although we have never had any dispute case in the past, in order to make clear understanding with our customer, we set terms and conditions of our wedding photography service as follows.
(Pricing)
Price is in FJD$, and Fiji Government Tax VAT 15% is included.
Price in Price list is valid from now to 31st December 2024.
Price is subject to change without notice due to change of government tax policy or our supplier’s price.
(Payment & Cancellation Policy)
30% non-refundable deposit is required within 10days after your intention to confirm booking, and it is non-refundable except for our reason. 30% Cancellation fee will be applied to all confirmed package items.
Balance must be paid by 30 days prior to wedding date, and it is non-refundable except for our reason. In case of no payment by 30days prior to wedding date, we have the right to release the booking if we have no reply within 5 days after we send a reminder email. Cancellation fee will be 100% if it is cancelled at prior to 30 days before the booking date. Weather, environment, political reason, pandemic are not our reasons. We request you to have travel insurance to avoid loss by accidents, natural disaster and unexpected events.
We still apply Covid Postponement Policy in which we will not charge any penalty and fee if you face travel restrictions due to Covid except for our incurred cost to change our travel bookings.
(Delivery Schedule)
We firstly try to complete all the retouch and deliver your photos in disc before you fly out, however in busy season we may have to advise you that we will send by registered post within 6 weeks(maximum) plus shipping time. In case of shipping, the cost is included in price, however if you fly out 2 days after the wedding day, we will charge shipping cost as extra. Photo Book delivery turnover is approximately 8 weeks.
(Responsibility)
Although we always try our best efforts to make the best results, we have no responsibility for results caused by following factors which is beyond our control.
1) Limitation given by venue’s policy and rule – such as prohibited area to enter, guest privacy policy such as people swimming at the background of ceremony venue etc. We will make recommendation for your results whenever we notice, and negotiation should be made between you and venue coordinator, and please understand that we have to respect rules and direction of resort operation side.
2) Delay of schedule caused by guests, other suppliers, weather conditions and other factors that is beyond our control.
3) Background and lighting conditions of the venue of the day
4) Obtrusive behaviour including guest photographers who come often in our way to your shots and also including many iPhone/Pad especially at the isle. We try to advise politely if that happens, but it will be beyond our control if too many Guest/iPhone photographers are standing in our way.
(Liability)
We have no liability to any injury or health issue. If you have any health issue such as back problem, pregnancy, please inform us in advance before shooting.
We have no liability to any loss or damage of physical items.
We have no liability if we fail to perform our jobs due to unsafe situations due to natural disasters, fire, offensive behaviour from person(s) at the event, War etc. and we have the right to leave the location of the event in the above situations.
In case of unlikely event that digital files are destroyed or stolen or camera’s malfunction for reasons beyond our control, our liability is limited to the return of all payments received. If the damaged data is partial loss, our liability to return payment is only for the percentage of the lost data to our total number of original data.
(Data Backup Policy)
We will keep your original data for one year as backup data. In case of lost data happened at your side within one year from wedding date, we could send it again with only shipping cost & copy cost charge. We will recommend you make multiple copies to any other media at your end, as we are not liable for the loss of images after one year from wedding date.
(Copyrights Rule)
No copyrights protection is added to all the data delivered to you, which mean you can use all the photos freely for your any personal purposes. (This is one of our customer-focused features) We also include copyrights release form with our signature in our package so that you don’t have any issues with printing/design company when using the data for your personal purposes. Please also be advised that No watermark will be added on the photos delivered to you.
However we would like to clarify following copyrights law recognised internationally as we still hold our copyrights for our purposes.
1. We have right to use our photos for our own promotional purposes in our web site, social media and any other media. If you don’t want to expose any of your photos in public, please inform us in advance, as we will respect your privacy if you wish not to expose your photos in public.
2. Our permission must be obtained if you would like to use the photos for Commercial purposes (which means you cannot make money using our photos for commercial purposes)
(Agreement)
We regard that you understand all the above by paying the deposit at the time of booking us.
